Cancellation and Returns Policy
1. General
This policy sets out the terms for order cancellations, product returns, and refunds on the "YadToYad" website.
The website sells second-hand products, particularly clothing and fashion items. The condition of each product may vary, and information regarding the product's condition, measurements, and known defects is provided on the relevant product page, where applicable.
This policy is subject to the Israeli Consumer Protection Law and any other applicable mandatory law. In the event of a conflict between this policy and a mandatory legal provision, the applicable law shall prevail.
2. Cancellation of a Distance Sale Transaction
An order placed through the website constitutes a distance sale transaction.
Under applicable law, a consumer may cancel a distance sale transaction for the purchase of a product within the period prescribed by law, subject to the applicable conditions and statutory exceptions.
As a general rule, the cancellation period is 14 days from the date the product is received or from the date the consumer receives the transaction details document, whichever is later, subject to applicable law.
3. How to Cancel an Order
A cancellation request may be submitted using the contact details provided on the website, including:
- Email.
- Telephone.
- An online cancellation mechanism, where available on the website.
The cancellation request should include the information necessary to identify the transaction, such as the customer's name and order details.
Where required by law, the website will provide an online means for submitting a cancellation request for transactions conducted through the website.
4. Standard Cancellation
In the event of a standard cancellation that is not due to a defect, non-conformity, or failure to deliver on time, the business may charge a cancellation fee as permitted by law.
The cancellation fee shall be 5% of the transaction price or NIS 100, whichever is lower, subject to applicable law.
In such cases, the customer will be required to return the product in accordance with applicable law.
The cost of returning the product in the case of a standard cancellation shall be borne by the customer, as provided by law.
5. Cancellation Due to Defect, Non-Conformity, or Failure to Deliver on Time
If the product received is defective, does not conform to the description or details provided regarding the product, or if the product was not delivered within the applicable delivery period, the consumer may cancel the transaction in accordance with their rights under applicable law.
In such cases:
- No cancellation fee will be charged.
- The return of the product will be handled in accordance with applicable law.
- The business will bear the cost of returning the product where required by law.
- The refund will be provided in accordance with applicable law.
6. Second-Hand Products and Product Condition
Products sold on the website are second-hand products and may therefore show signs of use, wear, or other characteristics consistent with their condition.
The business makes reasonable efforts to describe the condition of each product accurately and to disclose known material defects or characteristics on the relevant product page.
Customers are encouraged to review the product description, photographs, and measurements provided on the product page before making a purchase.
The fact that a product is second-hand does not limit statutory consumer rights and does not constitute a waiver of rights in the event of a defect or non-conformity.
7. Use of a Product After Receipt
In a distance sale transaction, the mere use of a product does not, by itself, automatically eliminate the consumer's statutory right to cancel.
However, the product must be returned in accordance with applicable law. Where the product has been damaged or its value has been reduced beyond what is permitted by law, the business may exercise the rights available to it under applicable law.
8. Products Excluded from the Right of Cancellation
The right of cancellation does not apply where the law provides an exception to the right of cancellation.
Among other statutory exceptions, the right of cancellation does not apply to underwear and swimwear.
Additional statutory exceptions may apply depending on the type of product or the circumstances of the transaction.
9. Returning the Product
In the event of a standard cancellation, the customer shall return the product in accordance with applicable law.
The product shall be returned to the business address or to another address provided to the customer for this purpose, as applicable and in accordance with the law.
The product should be returned in accordance with its condition when received, subject to the consumer's statutory rights and applicable law.
This policy does not require the product to be returned in its original packaging or with an original price tag, unless such a requirement expressly arises from applicable law.
10. Refunds
Once the cancellation request has been received and, where required, the returned product has been received and processed, the business will issue the refund in accordance with applicable law.
Under applicable law, in a distance sale transaction the refund will generally be issued within 14 days from the date the cancellation notice was received, subject to the applicable legal requirements and circumstances of the case.
The refund will generally be made using the original payment method, where possible and in accordance with applicable law.
11. Cancellation Before Dispatch
A customer may submit a cancellation request before the product has been shipped, subject to the applicable statutory cancellation rights.
If the order has not yet been dispatched, the business will make reasonable efforts to cancel the order and issue the applicable refund in accordance with the law.
12. Self-Pickup
Choosing self-pickup does not affect the consumer's statutory cancellation rights.
Where the transaction was made through the website, the consumer's rights will apply according to the nature of the transaction and applicable law, even if the product is collected in person.
13. Consumers Eligible for an Extended Cancellation Period
In circumstances specified by law, a consumer who is a person with a disability, a senior citizen, or a new immigrant may be entitled to an extended cancellation period of up to four months, subject to the conditions established by law.
Among other conditions, eligibility for the extended period in a distance sale transaction depends on the statutory requirements, including the existence of communication between the business and the consumer before the transaction, including electronic communication, as defined by law.
14. Refund of Shipping Costs
Where applicable law requires the business to refund amounts paid for shipping, such amounts will be refunded in accordance with the law.
In the case of a standard cancellation, any cancellation fee may be charged only within the limits and under the conditions permitted by law.
15. Contact
For order cancellations, product returns, or questions regarding refunds, customers may contact the business using the contact details provided on the website and in the Terms and Conditions.
16. General Provisions
Nothing in this policy is intended to limit or waive any consumer right granted under the Israeli Consumer Protection Law or any other applicable law.
In the event of a change in applicable law, the business will act in accordance with the law in force at the relevant time.
